The rules for using skailstudio.com, and what an inquiry does and does not commit either of us to.
1. Agreement to These Terms
These terms govern your use of skailstudio.com, run by Skail Consulting LLC (“we,” “our,” or “us”). By using the site you agree to them. If you do not agree, please do not use the site.
2. Use of the Site
You may browse the site and send us an inquiry for lawful, business purposes. You agree not to interfere with the site or its hosting, probe it for weaknesses, scrape it at a volume that affects other visitors, or submit anything unlawful, deceptive or malicious through the contact form.
3. Inquiries Are Not Contracts
Sending an inquiry, and any reply we give, does not create a client relationship or an agreement to do work. Descriptions of services, timelines and prices on the site or in early conversations are general information, not offers. Consulting work begins only under a written proposal, statement of work or services agreement signed or accepted by both you and Skail Consulting LLC, and that document governs the work.
4. Intellectual Property
The site, including its text, design, code, logo and the Skail name, belongs to Skail Consulting LLC or its licensors and is protected by intellectual property law. You may view it and share links to it. You may not copy, republish or reuse it, or use the Skail name or logo, without our written permission. Ownership of work delivered to a client is set out in the written agreement for that work.
5. What You Send Us
You keep ownership of what you submit. By sending it, you allow us to use it to read, answer and scope your inquiry, as described in our Privacy Policy. Please do not send confidential or sensitive information through the contact form before we have agreed in writing how it will be handled.
6. Third-Party Links
The site may link to websites we do not control. We are not responsible for their content or practices, and a link is not an endorsement.
7. Disclaimers
The site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will be uninterrupted or error free, or that its content is complete, current or suited to your situation. Nothing on the site is legal, financial or other professional advice.
8. Limitation of Liability
To the fullest extent the law allows, Skail Consulting LLC and its members, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or reliance on its content. Our total liability for any claim relating to the site is limited to one hundred US dollars ($100). Liability for consulting services is governed solely by the written agreement for those services.
9. Indemnification
You agree to defend and hold us harmless from claims, losses and costs arising from your misuse of the site or your breach of these terms.
10. Governing Law
These terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law rules. Any dispute about these terms or the site will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
11. Changes to These Terms
We may update these terms. The date at the top shows the latest revision, and continued use of the site after a change means you accept the updated terms.
